OTHER JURISPRUDENTIAL CASES

On this page I report some cases to answer the questions that the customer often brings to my attention:

  • what to do when the years pass and the Ministry of the Interior does not respond to the citizenship application?
  • what to do when an old criminal conviction prevents the granting of citizenship or the issuance of a residence permit for long-term residents (former residence card)?
  • what to do when the Consulate or Embassy denies (without providing any valid explanation) the entry visa to Italy?

CITIZENSHIP

A Ghanaian citizen applied for citizenship without receiving any response at the end of the 2nd year. I appealed to the Administrative Court against the Ministry’s silent non-fulfillment. Even before the hearing was set, the decree that conferred Italian citizenship arrived. ( read more )

REHABILITATION

CASE 1. Rehabilitation from a criminal conviction it is strongly recommended to the foreigner who has had a criminal conviction and to obtain the issue of a residence permit for long-term residents (former residence card) both to obtain Italian citizenship. Rehabilitation allows the sentenced person to “to clean up ”his criminal record, that is, to go back to being cleansed. TOof a client of mine, a citizen of Morocco, the Ministry of the Interior had not granted Italian citizenship due to a criminal record (dating back over time). I filed an application for rehabilitation at the Supervisory Court of Bologna, which rehabilitated my client from the legal consequences of the sentence. ( read more )

CASE 2 . Another case of rehabilitation for having committed the crime of receiving stolen goods and forgery. Following rehabilitation, the Nigerian citizen obtained Italian citizenship. ( read more )

VISA REFUSAL FOR EMPLOYMENT

CASE 1. The Consulate General of Italy in Lagos denied an entry visa for subordinate work to a Nigerian boy. I appealed to the Regional Administrative Court for Lazio , who accepted the appeal and ordered the Ministry to issue the visa. ( read more )
